It is difficult to trace full details of the path which irregular or illegal immigrants follow when seeking assistance in the network of the various hospital departments and health structures. The aim of this work was to analyze the health needs of immigrant people by reviewing the types of treatment given to them in the day-hospital of our Department of Migration Medicine. Our study analyzed day-hospital admissions between 2003 and 2009. The patient charts used for managing day-hospital activity were adopted in 2002 in conformity with the "OSI project". Despite scant attention from historiography, Portugal played an important role as a way station on the road to exile for many Republicans during and after the Spanish Civil War. The situation in the neighbouring country was not easy for these people, as Antonio Oliveira de Salazar’s regime —officially allied with Franco’s Spain— did not recognize them as political refugees, but as illegal immigrants to be returned to Spain, which would have catastrophic consequences for many of them. Although in the public debate immigration is considered as an emergency, this paper begins taking into account the real data of such a phenomenon, strongly decreased in the past 18 months. It is then examined the issue of the illegal immigrant in Italy from a criminal law standpoint, in order to overcome the idea of reducing it to trafficking, focusing rather on the human nature of each individual, always involved in the crime of aiding and abetting illegal immigration, not being the perpetrator of the said offence.
